Topic Tree - Terms of Use

  1. Background
    1. The "CSU Engineering Topic Tree – Prospective Student Branch" contains free online engineering topics (Topics) that are created, owned and funded by Charles Sturt University ABN 83 878 708 551 (CSU). The Topics are aimed at prospective students who may be considering pursuing an engineering degree.
    2. The Topics are administered by CSU. CSU will provide access to the Topics through the URL: https://csu.realizeithome.com/RealizeITapp/Student.aspx (Website). CSU will also upload all of the approved content for the Topics which may include images, text, graphics, data and other information (Content).
    3. These Terms set out the terms of use of the Topics, the Website and the Content.
  2. Acceptance of terms
    1. By using this Website, participating in any Topic and/or clicking the box that states you agree to these Terms, you acknowledge that you have read and agree to accept these Terms, which form a binding agreement between you and CSU.
    2. You may only use this Website, participate in any Topic and/or access the Content if you agree to be bound by these Terms, and comply with all applicable laws. If you do not agree to accept these Terms, you must cease any further access to the Website.
  3. Not a student of CSU
    1. Completion of any Topic or use of the Website does not result in you being enrolled as a student of CSU. It does not give you any right to access any CSU resources other than the Content and the Website.
  4. Registration
    1. To participate in any Topic you will be required to register a user account using your name, your email and a password. You must not create more than one account and must not misrepresent your identity.
    2. You must not provide your password or access to your user account to any other person.
    3. Registration for a user account is open to any age group. However, if you are under 18 years of age then you must obtain parental or guardian consent to use this Website and complete any Topic.
    4. CSU reserves the right to terminate your user account at any time. You may terminate your user account at any time.
  5. Right to change the Terms of Use, Forum or Content
    1. Please note that CSU may change these Terms at any time. We will post the amended Terms on the Website. If you continue to access the Website after the date of publication then you agree to be bound by the amended Terms.
  6. Use of Website
    1. You must only use the Website and/or participate in any Topic for its intended purpose.
    2. Any work you submit must be your own. You must not share your responses to any assessment tasks or any material provided to you through participation in any Topic. You must not engage in any activity which would dishonestly affect your results or the results of any other person participating in a Topic.
    3. You must not use the Website or participate in any Topic to post or disseminate any of the following prohibited material:
      1. content that defames, harasses or threatens others;
      2. content that infringes the intellectual property of others;
      3. content which breaches obligations of confidentiality;
      4. content that is obscene, indecent or unlawful;
      5. content regarding illegal activities with the intent to commit them or encourage others to do so;
      6. intentionally deceptive or misleading information; or
      7. advertising, marketing or promotional materials.
    4. You must not engage in any of the following prohibited activities in connection with the Website:
      1. access or attempt to access any other user’s account;
      2. reproduce, sell or use any portion of the Website or any Topic or use them for commercial purposes;
      3. online bullying or any other behaviour that could endanger the health or safety of any other person;
      4. behaviour that is disruptive to the learning of others that may restrict, disrupt or inhibit others from using the Website;
      5. use the Website to transmit unauthorised or unsolicited communications;
      6. introduce software, devices or data which are intended or which may damage or alter the Website or any Topic (including for example spyware, viruses, adware, malware, robots, spiders and web-scrapers); or
      7. breach the intellectual property, privacy, moral or other personal rights of CSU or any third party.
    5. You acknowledge and agree that CSU may monitor the Website, your use of the Website and any content that you post or disseminate. CSU reserves the right to remove any material posted or disseminated by you through the Website.
    6. CSU may report any breach of these Terms that may require investigation to any appropriate authority external to CSU.
    7. You may also report to CSU any behaviour or material which you think is in breach of the Terms, or if you have any concerns about a post, by emailing us on engineering@csu.edu.au. CSU will assess and respond to any concerns as it considers appropriate.
  7. Privacy and Personal Information
    1. Personal information collected from you (including your name and email address) will be managed in accordance with the NSW Privacy and Protection of Personal Information Act 1998 and CSU’s Privacy Management Plan.
    2. We will use your personal information in order to provide you access to the Website and Topics, to manage your participation in a Topic, to administer the Website, to contact you with further information in regard to CSU’s academic courses, events and services, for the purpose of evaluation and reporting on the success of the Website, and for research and education. Any reports produced as a result of using your personal information will not reveal your personal identity.
    3. CSU may engage third party providers to assist with the Website or provide underlying software. This may involve the transmission and storage of data including personal information in jurisdictions outside of Australia.
    4. If you use the Website or participate in any Topic, then you consent to this use of your personal information.
  8. Credit
    1. If you successfully complete any Topic, CSU may grant you credit in relation to that Topic if you enrol in the CSU Engineering degree.  CSU does not hold out that any Topic will be recognised by any other institution or education provider in any way.
  9. Intellectual Property –Content
    1. All Content made available through the Topics and/or the Website by or on behalf of CSU in whatever form is the property of CSU unless expressly stated otherwise.  CSU grants you a personal, non-exclusive and non-transferrable licence to use the Content for the purpose of participation and completion of any Topic and personal education only.
    2. You must not modify, copy, reproduce, republish or display any Content unless expressly authorised to do so on the Website or in writing by CSU. You must not frame the Website or any part of it within any other website.
    3. You must not use any trademark or logo of CSU without prior written consent from CSU.
  10. User Content and Identity
    1. When you participate in the CSU Engineering Topic Tree – Prospective Student Branch, you may have the ability to submit or upload materials eg assessment items (User Content). Where you make any User Content available through the Website then you:
      1. warrant that the User Content does not infringe the intellectual property, moral or privacy rights of any person;
      2. warrant that you have the rights to publish the User Content;
      3. grant to CSU a royalty-free, worldwide, perpetual, non-exclusive and transferrable right to use the User Content for education and research; and
      4. grant to each Topic participant a royalty-free non-exclusive right to use the User Content to the extent reasonably necessary to participate in the Topic.
    2. If you post any material in the CSU Engineering Topic Tree – Prospective Student Branch, then your posts can be seen by other users. Your user name will also be visible.
    3. Other users may also post material in the CSU Engineering Topic Tree – Prospective Student Branch, and these posts may contain opinions and personal expressions. CSU does not approve or endorse any opinions or expressions posted by any User and excludes all liability in relation to any such posts to the full extent permitted by law.
  11. External Sites
    1. The Website may contain hyperlinks to other websites that are not controlled by CSU. CSU does not endorse or make any warranty about the content or use of those websites or any of the products or services offered through them. You acknowledge that if you access linked third party content or websites then you do so at your own risk and CSU excludes all liability arising out of your use of them.
  12. Modification of Topic Content or Website
    1. CSU may modify or withdraw Topic content or the Website at any time.
  13. Indemnity and limitation of liability
    1. You indemnify CSU for all claims, losses or expenses which CSU may incur which arise from any breach by you of these Terms, any information that you post or disseminate through the Website or the Topics and infringement by you of any intellectual property, privacy, moral or other personal right of any third party.
    2. The Website and the Content are provided on an "as is" basis. To the full extent permitted by law, CSU excludes all warranties in relation to the Website and the Content, including any warranties as to accuracy or currency of content or suitability for purpose.
    3. You are responsible for protecting your own devices from viruses and other interruptions.
    4. CSU excludes all liability for any special, indirect, or consequential loss or damage including unauthorised access or damage to, or loss or misuse of information, data, hardware or software.
  14. General
    1. These Terms are governed by the laws of New South Wales. Any delay or failure to enforce any of these Terms is not a waiver. Any waiver must be in writing.
